An Act relative to non-medical switching

HD 3340 prevents health insurance plans from forcing patients to switch prescription drugs without medical justification ("nonmedical switching"). It specifically prohibits insurers from changing formularies or increasing costs for drugs a patient is medically stable on, as determined by their doctor, during the current plan year or open enrollment. The bill requires insurers to provide a clear process for patients to request coverage exemptions for their current drug, respond within 72 hours (24 hours in emergencies), and automatically grant exemptions if they miss deadlines. This directly protects patients with chronic conditions who rely on stable medication regimens. Insurers may only remove a drug from coverage if the FDA issues a safety warning or the manufacturer discontinues it.
