INSURANCE COMMISSIONER: Provides for confidential information relative to public inspection
HB 248 revises the rules for public access to insurance rates and supporting information filed with the Insurance Commissioner. While most of this information will be publicly available, insurers can mark certain data as confidential, trade secret, or proprietary. The Commissioner will decide if such marked information should be disclosed; however, if a request is made for marked information, the Commissioner must notify the insurer of their decision. Insurers then have ten days to request a hearing to challenge the Commissioner's determination, which temporarily stops the disclosure process. This ensures a review process for information designated as sensitive by insurers.

MODERATE
This bill shifts the responsibility for deciding if insurance rate information is confidential from the insurance company to the state commissioner. Previously, insurers could unilaterally claim their data was a trade secret; now, the commissioner must independently verify these claims before any information is withheld from the public. The bill also establishes a specific process where insurers can request a quick administrative hearing if their claim is challenged, and allows courts to review documents privately if necessary.
REQUIREMENT
Changed the authority to determine confidential information from the insurer/filer to the commissioner of insurance.
Added a requirement for the commissioner to notify the insurer and provide a written determination when a public request for confidential information is made.
TIMELINE
Added a 10-day window for insurers to request a hearing if they disagree with the commissioner's decision on confidentiality.
ENFORCEMENT
Added provisions for staying (pausing) the commissioner's decision if a hearing is requested and authorized in-camera review by courts.
