AN ACT relating to solid waste management facilities and declaring an emergency.

Added an exception to the fee exemption rule, stating it does not apply to fees agreed upon in private franchise contracts between service providers and counties.

Expanded the definition of 'municipal solid waste disposal facility' to include residual landfills or incinerators handling industrial waste, unless the site is exclusively owned and operated by the waste generator on contiguous property.

Clarified that industrial waste sites owned by generators are excluded from the new facility definition only if they are located in the same county as the generator or if located elsewhere, they must strictly accept waste only from that specific generator.
