MODERATE
This bill modifies Indiana's eviction expungement law to automatically order record sealing in qualifying cases rather than requiring tenant requests, and adds a new eligibility category for cases where seven years have passed since filing without a money judgment. The changes streamline tenant relief by reducing administrative burdens and expanding protections for tenants facing eviction.
Scope change
Expanded from requiring tenant-initiated expungement requests to automatic court-ordered sealing, and added a new seven-year eligibility window for cases without money judgments.
ELIGIBILITY
Changed expungement process from tenant-requested to automatic court order in qualifying cases.
Added new eligibility category for cases where seven years have elapsed since eviction filing without a money judgment against the tenant.
TIMELINE
Added effective date of January 1, 2028 for the seven-year eligibility provision.
REQUIREMENT
Reorganized subsection structure to clarify when courts must issue expungement orders.
