MODERATE
This bill was amended to clarify definitions and add enforcement powers for small-scale land disturbances. The changes define what constitutes a 'land disturbing activity' and allow state agencies to issue warnings or stop work orders for small projects under one acre that fail to control sediment or dust.
Scope change
The bill's scope was expanded to include enforcement mechanisms for small-scale land disturbing activities that were previously not addressed.
DEFINITION
Added a new definition for 'land disturbing activity' that includes removing vegetative cover, excavating, filling, and grading.
ENFORCEMENT
Added authority for state units or IDEM to issue written warnings and stop work orders for small land disturbing activities under one acre that fail to control sediment or dust.
REQUIREMENT
Modified the structure of the original section to accommodate the new enforcement provisions, renumbering subsections from (a) and (b) to (a), (b), (c), and (d).
TIMELINE
Added a 48-hour window for initiating corrective action after a written warning before a stop work order can be issued.
