MHDD-SERVICES-MINIMUM STNDS

Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that "community mental health services and programs", for purposes of meeting minimum standards, includes peer support, residential support services, assertive community treatment, skill development, vocational training, residential supports for children and adults, and transportation. Effective July 1, 2005.

CRIM CD-DISORDERLY CON

Amends the Criminal Code of 1961. Provides that a person commits disorderly conduct when he or she knowingly possesses while on, brings onto, or causes to be brought onto school property, any B-B gun which expels a single globular projectile not exceeding .18 inch in diameter and which has a maximum muzzle velocity of less than 700 feet per second without the consent of the chief security officer for such school property. Provides that a violation is a Class A misdemeanor.

ELECTIONS REFERENDA TIMING

Amends the Election Code. Provides that when the voters of a unit of local government or school district fail to approve the same public question twice within 36 months, the unit of local government or school district may not submit that question to the voters until at least the second next election of the same type at which the question most recently failed.

VEH CD-MOTORIZED SCOOTERS

Amends the Illinois Vehicle Code. Provides that a person must have a valid driver's license or permit to operate a motorized scooter or electric personal assistive mobility device on a road or highway. Provides that the person may not exceed a speed of 20 miles per hour. Provides that a person may not operate the scooter or device on a road or highway after sunset and before sunrise. Provides that the operator must wear a helmet and may not carry passengers. Provides that a violation is a petty offense. Sets penalties.

CIV PRO-HOMESTEAD EXEMPTION

Amends the Code of Civil Procedure. Increases the amount of the homestead exemption from $7,500 to $100,000. Provides that if 2 or more individuals own property that is exempt as a homestead, the value of the exemption of each individual may not exceed his or her proportionate share of $200,000 (instead of $15,000) based upon percentage of ownership. Effective immediately.

FINANCIAL INSTITUTIONS-FEES

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

MARRIAGE ACT-CHILD MOVING

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that the court may consider the financial advantage to the custodial parent when determining the best interest of the child for purposes of moving the child from Illinois.

RIVERBOATS-BAN FROM TIF DISTS

Amends the Riverboat Gambling Act. Provides that any owners license and any riverboat home dock relocation authorized on or after the effective date of this amendatory Act of the 94th General Assembly shall not authorize the conduct of riverboat gambling operations from a home dock that is located within the boundaries of a redevelopment project area under the Tax Increment Allocation Redevelopment Act in the Illinois Municipal Code. Effective immediately.

HWY CD-IDOT FUEL TAX AUDITS

Amends the Illinois Highway Code. Provides that the Department of Transportation, in reviewing for approval any ordinance or resolution passed or adopted by any municipality for expenditure of motor fuel tax funds for construction, a highway program, or a contract, shall rely on the audit conducted by the municipality to determine whether the proposed expenditure of those motor fuel tax funds is for an authorized purpose.

LAW ENFORCE OFFICERS SAFE ACT

Creates the Law Enforcement Officers Safety Act. Provides that notwithstanding any other provision of the law of this State or an ordinance of any political subdivision of this State, an individual who is a qualified law enforcement officer or a qualified retired law enforcement officer and who is carrying specified identification may carry a concealed firearm in this State. Amends the Criminal Code of 1961 to exempt these qualified law enforcement officers and qualified retired law enforcement officers from certain unlawful use of weapons provisions and from aggravated unlawful use of a weapon provisions.
