CRIM CD-DISORDERLY CON

Amends the Criminal Code of 1961. Provides that a person commits disorderly conduct when he or she knowingly possess while on, brings onto, or causes to be brought onto school property, a device manufactured and designed to be substantially similar in appearance to a firearm without the consent of the chief security officer for such school property.

VEH CD-WIRELESS PHONES

Amends the Illinois Vehicle Code. Provides that a person who holds an instruction permit may not use a wireless telephone while driving a vehicle. Provides that a violation is a petty offense punishable by a fine of not more than $79. Provides that the provision does not apply to the use of a wireless telephone for emergency purposes.

VIATICAL STTLMNT ACT 2006

Creates the Viatical Settlements Act of 2006. Provides for the regulation of viatical settlement providers, brokers, and life insurance producers who enter into viatical settlements. Provides license requirements and establishes grounds for the suspension, denial, nonrenewal, or revocation of a license. Requires viatical settlement contracts and disclosure statements to be approved by the Secretary of Financial and Professional Regulation. Requires certain documents to be kept by licensees for examination by the Secretary and sets guidelines for examination by the Secretary. Provides a period of time for rescission after certain disclosures are made. Sets forth rules that must be complied with by viatical settlement providers and insurers. Requires certain disclosures to be made in connection with viatical settlements. Sets forth prohibited practices and exceptions. Grants the Secretary the authority to adopt rules. Provides standards for application by current viatical settlement providers. Sets forth violations and penalties for violations. Provides standards for advertisement of viatical settlement services and contracts. Provides that the Illinois Securities Law of 1953 is not preempted or limited by the Act and amends the Illinois Security Law of 1953 to include viatical investments in a definition of "security" and to add a definition of "viatical investment". Provides that the provisions of the Act are severable. Repeals the Viatical Settlements Act. Amends the Freedom of Information Act to exempt from disclosure certain documents required under the Viatical Settlements Act of 2006. Amends the Illinois Insurance Code to provide that engaging in acts or practices prohibited by the Viatical Settlements Act of 2006 constitutes an unfair method of competition and unfair and deceptive act or practice in the business of insurance. Effective immediately.

GENERAL REVENUE FUND TRANSFERS

Amends the State Finance Act. Provides that the Governor may, through June 30, 2005 (now, 2007), direct the State Treasurer and the Comptroller to transfer a specified sum from any fund held by the State Treasurer to the General Revenue Fund to defray operating costs for the current fiscal year. Provides that no amounts may be transferred from the Road Fund, the State Construction Account Fund, the Criminal Justice Information Systems Trust Fund, the Wireless Carrier Reimbursement Fund or the Mandatory Arbitration Fund (now, no amount may be transferred from those funds for FYO5 through FY07). Effective immediately.

CRIM CD-LIMITATIONS

Amends the Criminal Code of 1961. Extends the statute of limitations for an offense based upon misconduct in office by a public officer or employee to no more than 6 (rather than 3) years beyond the expiration of the period otherwise applicable. Excludes from the period of limitations any period in which the defendant is a public employee and the offense charged is theft of public funds while in public employment.

FINANCIAL INSTITUTIONS-FEES

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

CRIM CD-CRIM SEX ASSAULT

Amends the Criminal Code of 1961. Provides that criminal sexual assault also occurs when a person commits an act of sexual penetration with a victim who is under 19 years of age and is still attending high school when the act was committed and the accused was 17 years of age or older and held a position of trust, authority, or supervision at the same high school. Provides that a violation is a Class 1 felony for a first offense and a Class X felony for a second or subsequent offense.

TECH RESCUE TEAM-USER FEE

Amends the Counties Code. Authorizes a county board to impose a reasonable user fee against any party directly or proximately responsible for the need for the use of emergency response services provided by a technical rescue team. Requires all technical response team user fees collected by the county to be deposited into a fund dedicated to the operation of technical rescue teams. Makes other changes.

VEH CD-DECORATED MILITARY PLTS

Amends the Illinois Vehicle Code and the State Finance Act. Provides for the issuance of Military Multi-Decorated license plates to Illinois residents who meet eligibility requirements to be prescribed by the Secretary of State. Provides that an applicant shall be charged an additional fee of $25 at original issuance and renewal. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the original issuance fee and $23 of the renewal fee shall be deposited into the Department of Veterans' Affairs MIA/POW Scholarship Fund. Creates the Department of Veterans' Affairs MIA/POW Scholarship Fund as a special fund in the State treasury. Provides that all moneys in the Fund shall be used as grants for scholarships awarded under the MIA/POW scholarship provision of the School Code. Effective immediately.
