SCH CD-REQUIRE COMMUNITY SERV

Amends the School Code. Provides that as a prerequisite to being promoted to the next higher grade level and to receiving a high school diploma, each pupil in grades 9 through 12 must complete at least 15 hours of community service each school year. Allows up to 5 of these 15 hours of community service to be performed by the parent or guardian of the pupil if the parent or guardian performs the community service with and at the same time as the pupil. Effective immediately.

AUTOMATIC IRA PROGRAM ACT

Creates the Automatic Individual Retirement Account Program Act. Establishes a portable retirement savings program for employees of employers that have not offered a qualified retirement plan to their employees within the last 2 years. Provides for the deduction of moneys from the wages of persons enrolled in the program. Provides for the deposit of those moneys in the Automatic IRA Program Fund. Authorizes a 7-member board to invest those moneys, choose permitted retirement program investment options, and make other programmatic decisions. Sets forth requirements pertaining to the Board and its composition and duties. Grants the Department of Employment Security administrative and enforcement powers. Also contains provisions concerning: investment firms; permissible investments; default enrollee contributions; investment policies; payroll deduction retirement savings arrangements; duties and liabilities of the State and employers; enrollee information packets; required audits and reports; penalties; rules; and program implementation. Amends the State Finance Act. Adds the Automatic IRA Program Fund and the Department of Employment Security Administrative Enforcement Fund. Effective immediately.

ELEC CD-EXTEND GRACE PERIOD

Amends the Election Code. Provides that grace period voting may be conducted until the day of the primary or election.

STATE POLICE-GANG DATABASE

Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Provides that the Department of State Police may make the information contained in the Statewide Organized Criminal Gang Database (SWORD) electronically available to the general public (rather than only prosecutors and law enforcement agencies).

HYDRAULIC FRACTURING BAN

Amends the Illinois Oil and Gas Act. Provides that no person shall conduct high volume horizontal hydraulic fracturing operations without express legislative authorization, which shall not be granted until after receipt of the findings and recommendations of the Hydraulic Fracturing Task Force. Creates the Hydraulic Fracturing Task Force. Provides that the purpose of the Task Force is to conduct a thorough review of the regulation of hydraulic fracturing operations in Illinois and to gather information, review, evaluate, and make recommendations regarding the regulation of hydraulic fracturing operations in Illinois. Sets forth the membership of the task force. Provides that the Task Force shall provide its findings and recommendations to the General Assembly within 2 years after the effective date of the amendatory Act. Repeals the provisions creating the Task Force on July 1, 2016. Effective immediately.

CRIM CD-CRIM DEFACEMENT

Amends the Criminal Code of 2012. Provides that in addition to any other sentence that may be imposed for criminal defacement of property, a person convicted of criminal defacement of property (rather than criminal defacement of property that is chargeable as a Class 3 or 4 felony) shall be subject to a mandatory minimum fine of $500 plus the actual costs incurred by the property owner or the unit of government to abate, remediate, repair, or remove the effect of the damage to the property. Provides that to the extent permitted by law, reimbursement for the costs of abatement, remediation, repair, or removal shall be payable to the person who incurred the costs. Provides that if the offense is gang-related, the fine shall be at least $1,000.

CIV PRO-END LEASE-GANG ACTIVTY

Amends the Code of Civil Procedure. Provides that a gang-related activity, as defined by the Illinois Streetgang Terrorism Omnibus Prevention Act, is a sufficient basis to terminate a lessee's lease. Provides a procedure and standards for a person who resides, works, or owns property in a building, or a neighbor within a 2-block radius of the building, to report that a tenant in the building is using a leased premises in gang-related activity. Provides that a person reporting the gang-related activity may give notice of the activity and demand that the landlord commence an investigation and, if warranted, a forcible entry and detainer action. Provides that if the landlord, after receipt of a notice and demand, refuses to investigate or finds no gang-related activity, the person who issued the notice and demand may petition the court to determine if the tenant allowed gang-related activity to occur at the leased premises, and if so, to order the tenant to vacate the premises. Provides remedies to the prevailing party in an action initiated under the new provisions by a person other than the landlord.

CRIM CD-FIREARM-FELON&MINOR

Amends the Criminal Code of 2012. Provides that it is a Class 2 felony (rather than a Class 3 felony) to knowingly sell or give a firearm to a person who has been convicted of a felony or to a person under 18 years of age who does not possess a valid Firearm Owner's Identification Card. Effective immediately.

SMOKE FREE CAMPUS ACT

Creates the Smoke-Free Campus Act. Sets forth the General Assembly's findings. Provides that beginning on July 1, 2014, smoking is prohibited on each campus of a State-supported institution of higher education. Provides that on or before December 31, 2013, each State-supported institution of higher education shall establish a community task force for the purpose of coordinating with community and campus leaders for the implementation of the Act. Provides that the governing board of each State-supported institution of higher education shall implement the Act and shall promulgate all policies and regulations necessary for this purpose, including, but not limited to, disciplinary action, fines, and an appeals process. Effective immediately.

CRIM CD-PROSTITUTION-PENALTY

Amends the Criminal Code of 2012. Deletes provision that enhances the penalty for prostitution to a Class 4 felony if the offense is committed within 1,000 feet of real property comprising a school. Deletes provision that a second or subsequent prostitution violation, or any combination of convictions for prostitution and solicitation of a sexual act, promoting prostitution, promoting juvenile prostitution, soliciting for a prostitute, soliciting for a juvenile prostitute, pandering, keeping a place of prostitution, keeping a place of juvenile prostitution, patronizing a prostitute, patronizing a juvenile prostitute, pimping, juvenile pimping, aggravated juvenile pimping, or exploitation of a child, is a Class 4 felony. Effective immediately.
