MODERATE
This bill was converted from an 'Engrossed' draft to an 'Enrolled' final version, which involved replacing the original text about dental insurance assignment with entirely new provisions protecting patient access to discounted pharmaceuticals. The changes shift the bill's focus from regulating how patients assign dental insurance claims to preventing pharmaceutical manufacturers from interfering with hospitals' ability to receive discounted 340B drugs.
Scope change
The bill's scope changed from regulating dental insurance assignments to regulating the distribution of 340B drugs to safety-net hospitals and pharmacies.
SCOPE
Removed all text regarding the assignability of dental and accident/health insurance policies.
DEFINITION
Added new definitions for '340B contract pharmacy', '340B covered entity', '340B drug', 'Manufacturer', and 'Safety-Net Hospital'.
REQUIREMENT
Added a prohibition on manufacturers or others from denying, restricting, or interfering with the acquisition or delivery of 340B drugs to covered entities.
Added a prohibition on requiring covered entities to submit ingredient cost or pricing data unless required by law.
TIMELINE
Added a requirement for covered entities to submit annual reports to the General Assembly by August 1, with exemptions for small hospitals and Critical Access Hospitals until 2029.
