BEST CONSUMER PRICE ACT

Summary
Creates the Best Customer Price Act. Provides that a public institution of higher education or a State agency may require best customer pricing for any goods it procures. Provides that the supplier or reseller shall include a provision in the letter of supply from the manufacturer that the supplier or reseller can secure the supply and quantity of goods to be purchased, and that the manufacturer has extended the same best customer pricing from the manufacturer to each of the suppliers or resellers registered with the State for the goods to be purchased. Provides that, if a public institution of higher education or a State agency requires best customer pricing for the goods but does not believe the price is competitive, the public institution of higher education or the State agency may decline to award the bid. MINOR
The bill was amended to clarify that the 'Best Customer Price Act' only applies when a public institution or agency explicitly chooses to require best pricing, rather than being mandatory by default. Additionally, the effective date was moved from immediate enactment to January 1, 2031, giving suppliers time to adjust their pricing structures before the law takes effect.
Scope change
The scope of applicability was narrowed to require an affirmative choice by the purchasing entity to enforce best customer pricing, and the timeline for implementation was extended significantly.
REQUIREMENT

Changed the requirement for best customer pricing from a general mandate to one that applies only if a public institution or agency affirmatively requires it for a specific procurement.

TIMELINE

Extended the effective date of the Act from immediate enactment to January 1, 2031.

Added a new repeal section stating that the Act will be repealed on January 1, 2031.
