Makes various amendments to the State Ethics Code. Repeals exemption from certain financial disclosure requirements granted to members of the Hawaii Correctional System Oversight Commission. (SD1)
Prohibits the suspension or expulsion of children participating in the Executive Office on Early Learning's Public Prekindergarten Program, except under limited circumstances. (SD2)
Prohibits the manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds, regardless of the type of firearm with which the magazine is compatible. Allows possession of large-capacity magazines that were legally possessed prior to the effective date of this Act. Allows acquisition by means of inheritance of large-capacity magazines that were legally in possession prior to the effective date of this Act. Allows possession and use by law enforcement agencies and officers. Allows the use of blank-fire assault weapons and detachable ammunition magazines with a capacity in excess of ten rounds for use solely as props for motion picture film or television program production when authorized by the chief of police of the appropriate county and not in violation of federal law. Prohibits foreign nationals and foreign corporations from making independent expenditures. Requires every corporation that contributes or expends funds in a state election to file a statement of certification regarding its limited foreign influence. Requires noncandidate committees making only independent expenditures to obtain a statement of certification from each top contributor required to be listed in an advertisement. (SD2)
Requires a personal representative of a decedent appointed under the Uniform Probate Code to notify the police department of the appropriate county of any and all firearms in an estate. Requires the police department to certify that all registered firearms in an estate and other firearms of which the police department has been notified are properly transferred or disposed of before the estate may close. Takes effect 12/1/2020. (SD1)
Includes coercion as a means of committing the offense of sex trafficking. Removes the criminal statute of limitations for sex trafficking. Specifies that sex trafficking of a minor is a strict liability offense. Repeals the offense of solicitation of a minor for prostitution. (SD1)
Bans the sale of flavored tobacco products. Prohibits mislabeling of e-liquid products containing nicotine. Establishes fines and penalties for violations. Authorizes a court to impose, as a penalty on a person eighteen to twenty-one years of age who is convicted of possession of a tobacco product or electronic smoking device, the requirement to complete a tobacco education program, complete a tobacco use cessation program, or perform community service instead of paying a fine. Effective 9/1/2020. (SD2)
Clarifies the meaning of "program or activity receiving state financial assistance". Excludes cases within the scope of the Individuals with Disabilities Education Act from the jurisdiction of the Hawaii civil rights commission. (SD2)
Establishes a hemp processor registry for hemp-derived products that consists of labeling and independent laboratory testing to ensure products do not contain contaminants unfit for human consumption. Prohibits hemp processors, distributors, and retailers from making unwarranted health claims of their hemp-derived products. Prohibits the sale or furnish of any hemp product to a person under twenty-one years of age. Prohibits the sale, hold, offer, or distribution for sale of any hemp-derived products designed to be appealing to children. Requires these products to be properly labeled to be legally allowed for sale in the State. Requires certain warning statements to be placed on the packaging of hemp-derived products. Establishes penalties. Appropriates funds. Effective 7/1/2050. (SD1)
