SB 1057 Hawaii Senate · 2026 Regular Session

RELATING TO PROCUREMENT.

Summary
Clarifies that the bid incentive given to bidders for public works construction projects who are parties to an apprenticeship agreement is based on apprenticeable trades utilized, rather than employed, to construct the public works. Requires the bidder and the bidder's subcontractors to be parties to all apprenticeable trades utilized to construct the project for which a state-approved apprenticeship program exists. Effective 7/1/2050. (SD2)

MINOR
This bill amends Hawaii's public works bid incentive program to require not just the main contractor, but also all subcontractors, to participate in state-registered apprenticeship programs. The change aims to ensure a broader supply of skilled labor by expanding the incentive's reach down the supply chain, rather than focusing only on the primary bidder.
Scope change
The bill's scope expanded from applying only to the primary contractor (bidder) to now also applying to all subcontractors utilized on the project.
REQUIREMENT

The requirement to receive a 5% bid preference now mandates that both the bidder and their subcontractors must be parties to registered apprenticeship agreements for all trades used on the project.

ELIGIBILITY

Eligibility for the bid preference was updated to require proof that subcontractors are also enrolled in apprenticeship programs, not just the main contractor.

ENFORCEMENT

Compliance verification now requires the bidder to certify that both they and their subcontractors are participating in apprenticeship programs, with failure by either party subject to sanctions.
