MODERATE
This bill revision updates the Mauna Kea Stewardship and Oversight Authority (MKSOA) timeline and authority, primarily to address potential failures in meeting management deadlines. It adds specific reversion dates (June 30, 2028, and December 31, 2029) where authority would return to the University of Hawaii if a management plan or administrative rules are not adopted on time. The revision also clarifies that MKSOA's interest in the land cannot exceed the University of Hawaii's leasehold interest unless agreed upon by the Board of Land and Natural Resources.
Scope change
The bill's scope regarding land tenure was narrowed by explicitly limiting the Authority's interest to match the University's leasehold interest, and the timeline for authority transfer was extended to December 1, 2029, with new conditional reversion dates added.
TIMELINE

Added conditional reversion dates of June 30, 2028, and December 31, 2029, which trigger a return of management authority to the University of Hawaii if the Authority fails to adopt a management plan or send proposed rules to the Governor by those deadlines.

Extended the transition period for transferring powers and duties from the University of Hawaii to the Authority from July 1, 2028, to December 1, 2029.

REQUIREMENT

Added a requirement that the Authority's interest in Mauna Kea lands must not exceed the University of Hawaii's leasehold interest unless the Board of Land and Natural Resources agrees otherwise.

Clarified that the Authority may extend existing leases and subleases before the transition period expires, with specific exemptions from certain term restrictions.
