Relief/Heriberto A. Sanchez-Mayen/City of St. Petersburg; Provides an appropriation to compensate Mr. Sanchez-Mayen for injuries sustained as result of negligence of City of St. Petersburg; provides limitation on compensation & payment of attorney fees. CLAIM: $2,300,000
Perfluoroalkyl and Polyfluoroalkyl Substances; Prohibits, beginning on specified date, certain use & sale, purchase, or distribution of aqueous film-forming foam; requires, beginning on specified date, certain entities to submit aqueous film-forming foam inventories & disposal plans to DEP; prohibits, beginning on specified date, possession & use of aqueous film-forming foam; authorizes DEP to administer certain grants or cost share programs; provides penalties & injunctive relief; requires certain public entities disposing of domestic wastewater biosolids and treated effluent to quarterly conduct specified samplings & submit results to DEP; limits purpose such samplings until specified standards are established by EPA & adopted by DEP.
Domestic Violence and Protective Injunctions; Reclassifying penalties for committing a domestic violence offense if a person has a prior conviction for domestic violence; providing that sentencing and incentive gain-time eligibility determinations are made without regard to a penalty enhancement; establishing an electronic monitoring pilot program in a specified county; requiring the sheriff, in consultation with certain persons, to design and implement the pilot program; providing requirements for the pilot program; requiring the Department of Corrections to complete an evaluation and provide specified reports to the Legislature; requiring the Department of Law Enforcement to enter injunctions against dating violence and sexual violence into a statewide verification system, etc.
Stalking ; Creates offense of aggravated stalking based on nonconsensual entry upon victim's property or interference with victim's property in course of committing offense of stalking; creates offense of sexually aggravated stalking based on certain sexual conduct in course of committing offense of stalking; ranks offenses created by act on offense severity ranking chart of Criminal Punishment Code; revises definition of "qualifying offense."
THC; Provides that marijuana testing laboratory may acquire hemp & hemp extract only from certain businesses; prohibits marijuana testing laboratory from selling, distributing, or transferring hemp or hemp extract from certain businesses; requires marijuana testing laboratory to separate marijuana received from certain entities from hemp or hemp extract received from certain entities; revises requirements for sale & distribution of hemp extract; prohibits businesses or food establishments from possessing hemp or hemp extract products that are attractive to children; prohibits unpermitted business sales, street sales, or festival sales of hemp extract; prohibits business permitted to sell hemp or hemp extract from being located in certain areas; provides requirements for businesses permitted to sell hemp or hemp extract; including THC-infused beverages in list of products prohibited for sale to person under 21 years of age; provides penalty for hemp extract possessed, manufactured, delivered, held, offered for sale, distributed, or sold by certain entities in violation of specified provisions.
Refrigerant Safety and Agricultural Continuity; Requires DACS to provide annual report to Legislature by specified date; authorizes DACS to coordinate with certain entities for specified purpose.
Property Insurance Affiliates ; Requires insurers to provide to OIR documentation demonstrating that financial considerations & payments to affiliates are fair & reasonable; requires office to consider certain factors to determine whether such considerations & payments are fair & reasonable; requires compensation arrangements between insurers & affiliates to be structured as fees for service; requires insurers to submit, & office to review, audited financial statements; requires contracts between insurers & affiliates to contain certain provisions; authorizes office to issue orders restricting fund transfers from insurers to affiliates under certain circumstances; requires affiliates to make certain refunds under certain circumstances; provides authority of office over affiliate dividends; requires affiliates to register with office.
Health Insurer Accountability; Requires health plan to participate in filed claim dispute; provides penalties for failure to respond to claim; requires AHCA to notify certain entity within specified timeframe when health plan fails to pay provider; requires health plan to pay provider within specified timeframe after agency's order; provides credentialing requirements for managed care plan; requires each managed care plan to identify to agency & OIR any ownership interest of affiliation of any kind with certain entities; provides requirements for identification of such information; removes provision requiring results of certain audit reports to be dispositive; requires managed care contracts to include provider notifications regarding certain denials of coverage; prohibits insurer from denying certain claims; provides notification requirements & penalties.
Information Technology Procurement and Contracting; Revises duties & requirements of Florida Digital Services; creates the Bureau of Enterprise Project Management and Oversight; provides duties & requirements of the bureau; requires state agencies include follow certain processes and use certain forms; requires certain information be included in specified contracts; revises requirements for certain contracts; requires DMS to create a repository for certain records; revises requirements for information technology competitive solicitations.
Child Welfare; Provides that new medical report relating to provision of psychotropic medication to child in legal custody of DCF may be required only under certain circumstances; requires DCF & each community-based care lead agency to coordinate with certain organizations & meet quarterly; requires DCF & each community-based care lead agency to make certain information available on their respective websites; requires, beginning in specified year, DCF & each community-based care lead agency to publish on their respective websites biannual report containing specified information; requires caregiver to provide weekly cash allowance to each child in his or her care beginning when child attains certain age; requires physician to provide to pharmacy copy of certain documentation, rather than signed attestation, with certain prescriptions.
