Rep. David Borrero

Perfluoroalkyl and Polyfluoroalkyl Substances; Prohibits, beginning on specified date, certain use & sale, purchase, or distribution of aqueous film-forming foam; requires, beginning on specified date, certain entities to submit aqueous film-forming foam inventories & disposal plans to DEP; prohibits, beginning on specified date, possession & use of aqueous film-forming foam; authorizes DEP to administer certain grants or cost share programs; provides penalties & injunctive relief; requires certain public entities disposing of domestic wastewater biosolids and treated effluent to quarterly conduct specified samplings & submit results to DEP; limits purpose such samplings until specified standards are established by EPA & adopted by DEP.

Domestic Violence and Protective Injunctions; Reclassifying penalties for committing a domestic violence offense if a person has a prior conviction for domestic violence; providing that sentencing and incentive gain-time eligibility determinations are made without regard to a penalty enhancement; establishing an electronic monitoring pilot program in a specified county; requiring the sheriff, in consultation with certain persons, to design and implement the pilot program; providing requirements for the pilot program; requiring the Department of Corrections to complete an evaluation and provide specified reports to the Legislature; requiring the Department of Law Enforcement to enter injunctions against dating violence and sexual violence into a statewide verification system, etc.

Systems of Law and Terrorist Organizations; Providing that the Department of State may administratively dissolve a corporation that has been designated as a terrorist organization in certain situations; providing that a person who receives military training from a domestic terrorist organization in certain situations commits a specified crime; providing a person who knowingly provides or attempts or conspires to provide material support or resources to a domestic terrorist organization commits a specified crime; providing that a person who willfully becomes a member of a domestic terrorist organization and serves under the direction or control of such organization with a specified intent commits a specified crime; authorizing the Chief of Domestic Security to designate an organization a domestic terrorist organization or a foreign terrorist organization if certain requirements are met; requiring the Chief to provide specified written notice to the Governor, the Cabinet, and the organization of the designation; providing that the Governor and the Cabinet may by a majority vote approve or reject the designation; requiring the Chief to publish such designation in the Florida Administrative Register within a specified time period after approval of the designation by the Governor and the Cabinet; providing that certain students of school districts and Florida College System institutions are ineligible for specified fee waivers; prohibiting students who promote domestic terrorist organization or foreign terrorist organizations from being awarded certain public institution funds, etc.

Land Use and Development Regulations; Requires amount of application fees associated with development permits or orders to reasonably relate to certain costs; requires public schools interlocal agreements to address reasonable access to certain public easements & public rights-of-way; requires local governments to administratively approve applications for minor special exceptions or variances submitted by large destination resorts that meet certain requirements ; requires local government comprehensive plans & land development regulations to include factors for assessing compatibility of certain residential uses; requires land development regulations to incorporate measures for mitigating or minimizing potential incompatibility; prohibits residential manufactured buildings from being denied a building permit for placement on certain lots; requires housing units located on a mobile home lot to be taxed in a specified manner and be subject to payments to a specified fund; requires off-site constructed residential dwellings to be permitted as of right in certain zoning districts; requires local government regulations to be reasonable and uniformly enforced.

Benefits for Obesity under the State Group Health Insurance Plan; Requires DMS to provide coverage for treatment & management of obesity for state group health insurance policies issued after specified date; provides coverage criteria; requires department to adopt eligibility criteria by specified date; provides reporting requirements.

Senior Management Service Class; Authorizes Chief Justice of Supreme Court to select specified number of non-managerial or policymaking positions within judicial branch for inclusion in Senior Management Service Class of Florida Retirement System; requires Executive Director & General Counsel of Florida Judicial Qualifications Commission to participate in Senior Management Service Class.

Freedom of Speech and Religious Expression in Public Schools; Prohibits school district from discriminating against students or school personnel on basis of political or ideological viewpoints or expression; prohibits penalty or reward for student's political or ideological expression in coursework, artwork, or other specified assignments; authorizes student to wear clothing, accessories, & jewelry displaying political or ideological messages or symbols; authorizes student to engage in political or ideological activities or expression; authorizes student to organize political or ideological groups, clubs, & other gatherings; requires that school district provide political or ideological groups with equal access to school facilities; authorizes political or ideological groups to advertise or announce meetings in same manner & to same extent as other groups; requires that DOE develop & publish model policy regarding limited public forum & political or ideological expression; creates private cause of action for persons & student organizations harmed by specified violations; provides for specified awards to such persons & organizations; authorizes such persons & organizations to use specified violations as defense or counterclaim; provides applicability; requires such actions to be brought within specified period of time; provides that state waives specified immunity; provides school district liability.

Law Enforcement, Correctional, and Institutional Security Specialist Officers; Requires average salary of correctional officer, correctional probation officer, or institutional security specialist to be no less than certain percentage of average salaries of sworn law enforcement officers; requires DMS to submit annual compensation analysis report to Governor, President of Senate, & Speaker of House of Representatives; requires annual salary increase for sworn law enforcement officers, correctional officers, correctional probation officers, & institutional security specialists; provides that Governor may authorize certain correctional officers, correctional probation officers, & institutional security specialists to assist with law enforcement operations during declared state or federal emergency.

Self-storage Spaces; Revises definition of term "last known address"; revises notice requirements of owners of self-storage units in order to enforce lien on tenant's property; requires that rental agreements for renters of self-storage units which are entered into on or after specified date provide certain information in compliance with Self-storage Facility Act; provides that failure or refusal of tenant to designate alternate contact does not affect tenant's or owner's rights or remedies; provides exception; authorizes owners of self-storage unit to send notice to certain tenants' last known address to apprise such tenants of specified right.

Adoption and Display of Flags by Governmental Entities; Prohibits governmental entity from displaying, placing, or causing to be placed certain flags on real property; specifies flags governmental entity may display on such property; provides requirements for governmental entity that displays flag of United States; prohibits local government from adopting certain ordinances or regulations relating to flag of local government; provides that certain ordinances & regulations are void.
