New paragraph (c) authorizes the Attorney General to use Delaware Health Fund moneys specifically to enforce and litigate the Tobacco Master Settlement Agreement (MSA) and the 2018 Non-Participating Manufacturers Adjustment Settlement Agreement (NPMSA), creating a new dedicated legal enforcement function for the fund.
New paragraph (i) establishes a competitive grant program administered by DHSS in consultation with the Division of Public Health, with a multi-step process: state-operated programs designated first, RFP issued by July 1, applications open at least 30 days, draft award list posted by October 15, Advisory Committee review by November 7, and final list transmitted to the Governor, OMB Director, Controller General, and Joint Finance Committee by November 15.
The SA 1 proposed an exception to the July 1 RFP deadline for the fiscal year July 1, 2026 to June 30, 2027 to allow preparation time. This exception was not included in the final enacted text, which retains a uniform 'no later than July 1 of each fiscal year' deadline.
The SA 1 proposed allowing the DHSS Secretary to name a designee on the Advisory Committee. The final text instead provides that the Chair of the Health Care Commission may designate a board member or staff person, shifting the designation authority to a different office.
Various technical and formatting corrections were made throughout the bill to conform to the Delaware Legislative Drafting Manual standards, including line break adjustments and punctuation changes.
