AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO AGENCY REGULATIONS.
What changed between versions
Removed the requirement that copies of the Register of Regulations be provided gratis to the two state daily newspapers. This was a provision added by House Amendment No. 2 that is now deleted in the final text.
Added a new editorial power (subsection (a)(3)(h)) allowing the Registrar to apply gender-neutral language in regulations when there is no ambiguity about which noun a pronoun replaces, aligning the Registrar's powers with those of Delaware Code editors.
Added a requirement that regulations published in the Register must comply with Chapters 101 and 104 of Title 29 and any rules or regulations adopted by the Registrar under Section 1134.
Removed the delayed effective date of July 1, 2027 for changes to Section 1134(a)(6) that had been added by House Amendment No. 2 to allow time for technological updates.
Changed the regulatory submission deadline from the 15th of the preceding month to the 1st of that month. Regulations received by the 1st are now published in the Register on the 15th, giving the Registrar more time for review and processing.
Changed agency submission duty from a general obligation to one triggered 'on the Registrar's request,' and added a requirement that the designated contact person must have familiarity with the Administrative Procedures Act.
Made numerous drafting corrections throughout to conform to the Delaware Legislative Drafting Manual, including changing 'all' to 'each' in various places, restructuring lists into numbered items, adding commas, and converting from passive to active voice.
