AN ACT TO AMEND TITLES 14 AND 29 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF SERVICES FOR CHILDREN, YOUTH AND THEIR FAMILIES AND EDUCATIONAL SERVICES.

Created an entirely new Chapter 24A in Title 14 (sections 2400A through 2407A) establishing the DSCYF Education Unit with definitions, purpose, staffing qualifications, job duties, salary rules, unit count exclusion, work hours, and limited LEA status.

The unit count exclusion (section 2405A) was retained in the final bill, reversing the intent of HA 1 which had sought to delete that provision because some DSCYF students might be included in unit counts under certain circumstances.

Amended Title 29 section 9006 to formally create the DSCYF Education Unit as a major organizational unit responsible for K-12 education programming in department-operated residential programs.

Established salary structure for Education Unit employees based on public education salary schedules (section 1305), with a specific formula converting 10-month salaries to 12-month salaries (divide by 0.7, multiply by 1.2), plus hazardous duty supplements for staff at Youth Rehabilitation Services facilities and administrative supplements for supervisors.

Required the Education Unit to comply with IDEA, Section 504 of the Rehabilitation Act, and Delaware's Exceptional Children chapter (Title 14 Chapter 31) for students with disabilities in department-operated residential programs.

Amended Title 29 section 9005 to require the DSCYF Secretary to appoint an Education Administrator/Director of Education Services as a named position.

Limited the Education Unit's status as a local education agency to only three purposes: loan forgiveness programs for educators, competitive grants awarded directly to LEAs, and credit-bearing course credits for youth.
