HB 302 Alaska House · 34th Legislature (2025-2026)

An Act relating to travel insurance; relating to the business of insurance; relating to exceptions to prohibited rebates; relating to the powers of the director of the division of insurance; relating to prohibited practices in the advertisement of insurance; relating to unemployment benefits; and providing for an effective date.

HB 302 defines key terms for travel insurance (like "group travel insurance" and "primary policyholder") and establishes tax rules for travel insurance premiums in Alaska. It requires travel insurers to document policyholders' residency or business location and report only the travel insurance portion of premiums, excluding travel assistance services or cancellation fees. The bill also adds a licensing requirement for individuals selling travel insurance in the state. These changes apply to travel insurers and affect Alaska residents purchasing travel insurance, as well as businesses with a principal place of business in Alaska.

MODERATE
The bill was dramatically narrowed in scope from a broad omnibus insurance measure covering travel insurance, unfair trade practices, rebates, advertising restrictions, and unemployment benefits to a focused act dealing solely with travel insurance. The new version retains only the premium tax provisions for travel insurers, the limited producer licensing framework (including a new travel insurance limited producer license), and the new Article 4 of AS 21.42 establishing travel insurance classification, eligible groups, sales practices, and definitions. All provisions related to value-added products and services, noncash gifts, raffles, prohibited advertising practices, rebate exceptions, and unemployment benefits were removed.
SCOPE

The bill title was changed from a multi-topic act (travel insurance, business of insurance, exceptions to prohibited rebates, powers of the director, prohibited advertising practices, unemployment benefits, effective date) to simply 'An Act relating to travel insurance.'

Removed the unemployment benefits provision and the effective date section that were part of the enrolled bill.

REQUIREMENT

Removed Section 5 (AS 21.36.110) which established exceptions to discrimination and rebate prohibitions, including detailed rules for value-added products or services offered at no cost or reduced cost, wellness program rewards capped at 20 percent of coverage cost, and noncash gift provisions for individual and commercial customers.

Removed Section 6 (new AS 21.36.110(b)-(e)) which set conditions for value-added products (cost must be reasonable relative to premium, aggregate cost capped by regulation, no unfair discrimination), a three-year pilot program option with 21-day director notice period, rules for noncash gifts and raffles in connection with insurance sales, and regulatory authority.

Removed Section 8 (AS 21.36.120(a)) amendment that clarified rebate and inducement prohibitions apply to property, casualty, and surety insurers and their agents or solicitors.

ENFORCEMENT

Removed Section 7 (new AS 21.36.115) which prohibited insurers and producers from offering insurance as an incentive for purchasing another policy or using words like 'free' or 'no cost' in advertisements to suggest coverage is free.

TECHNICAL

The retained travel insurance sections (premium tax in AS 21.09.210, limited producer licensing in AS 21.27.150(a), and new AS 21.42 Article 4) are substantively unchanged from the enrolled version, with only minor formatting differences in bracketed amendment language.
